By accessing or using Ultimate RMS, operated by Ultimate RMS Ltd ("we", "our", or "the Company"), including the website and software platform ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Ultimate RMS is a rental management software platform that helps businesses manage their rental inventory, bookings, customers, and payments. The Service is provided on a subscription basis.

3. User Accounts

To use the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to the Service

5. Payment Terms

Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data. We will not access, use, or share your data except as described in our Privacy Policy.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Ultimate RMS and are protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, Ultimate RMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance or updates that temporarily affect availability.

10. Termination

We may terminate or suspend your account at any time for violation of these terms. You may cancel your subscription at any time through your account settings.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction thereof.
